A sweeping decision by the 11th Circuit Court of Appeals treated discrimination against transsexuals as “sex discrimination” subject to intermediate scrutiny under the Equal Protection Clause of the Fourteenth Amendment. President Says "NO" to Executive Order on Sexual Orientation
As we previously reported, President Obama was considering an Executive Order prohibiting federal contractors from discriminating against individuals on the basis of sexual orientation. Despite pressure from Congressional Democrats and various civil rights organizations, the President has now stated that he will not issue such an Executive Order. Instead the President continues to seek passage of the Employment Non-Discrimination Act (ENDA) by Congress to ban discrimination against lesbian, gay, bisexual, and transgender workers by all employers, not just federal contractors.

The Equal Employment Opportunity Commission ("EEOC") says pregnancy discrimination is still rampant, more than 30 years after the passage of the Pregnancy Discrimination Act ("PDA"). Hearings were just held in Washington to discuss the problem. Pregnancy discrimination claims made up only 5.8% of the agency's caseload last year, but the EEOC is nonetheless poised to crack down on this form of discrimination.
